This BAA is incorporated into and forms part of the TherapistPal Pro Terms of Service. By acknowledging this BAA during signup, Covered Entity agrees to its terms.
Terms used in this BAA have the meanings set forth in HIPAA (45 CFR Parts 160 and 164), including but not limited to: Protected Health Information (PHI), Electronic PHI (ePHI), Breach, and Security Incident.
- Not use or disclose PHI other than as permitted by this BAA or required by law
- Use appropriate safeguards to prevent unauthorized use or disclosure of PHI
- Report any breach or security incident to Covered Entity without unreasonable delay
- Ensure any subcontractors who handle PHI agree to the same restrictions
- Make PHI available for access, amendment, and accounting as required by HIPAA
- Return or destroy PHI upon termination of the agreement
Business Associate may use and disclose PHI only to provide TherapistPal Pro services to Covered Entity, as required by law, or for proper management and administration of Business Associate.
This BAA remains in effect for the duration of the TherapistPal Pro subscription. Upon termination, Business Associate will retain PHI for 90 days then destroy it securely, unless retention is required by law.
